The patent system now administered by the United States Patent Office (USPTO) has been the wellspring of technological wonders and progress since it was conceived by the Founding Fathers in 1776. And for the last 250 or so years, the USPTO has compiled a mind numbing array of rules, practices, exceptions, and amendments to the exceptions which now define the patent system in the United States.
If you are representing yourself (ProSe) before the USPTO, you have entered this maze.
Not to worry.
As
we have written more than 1,000 USPTO Office Actions ourselves, we understand exactly how they are constructed, how to interpret each facet, and most importantly how to overcome USPTO rejections and objections under 35 U.S.C 101, 35 U.S.C 102, 35 U.S.C 103, 35 U.S.C 112, etc.
Office Action Response
We will research and analyze your pending patent application and write an appropriate Response which you can then file at the USPTO.
If you are still within a shortened statutory period (usually 1-3 months from the mailing date of the Office Action), our fee is $1,000 per Office Action Response. Note that you are also responsible for any USPTO government fees.
If you are past a shortened statutory period, but still more than one month before the end of the statutory period (which began at the mailing date of the most recent Office Action), our fee is $1,500 per Office Action Response. Note that you are also responsible for any USPTO government fees.
Examiner Interview support
We will research and analyze your pending patent application, prepare an agenda for an Examiner interview (including any proposed claim amendments) and participate along with you in an official Examiner Interview via telephone at a mutually agreeable time.
During the interview, we will direct the discussion and engage with the USPTO official with respect to your application with a goal to advance prosecution on the merits. Afterwards, we will translate the USPTO patentese into normal English and instruct you as to your options to move forward.
If you are still within a shortened statutory period (usually 1-3 months from the mailing date of the Office Action), our fee is $2,000 per Examiner Interview with support. Note that you are also responsible for any USPTO government fees.
If you are past a shortened statutory period, but still more than one month before the end of the statutory period (which began at the mailing date of the most recent Office Action), our fee is $2,500 per Examiner Interview with support. Note that you are also responsible for any USPTO government fees.
